1. Acceptance of Terms

Welcome to InSync! By accessing or using the InSync mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to update these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of InSync after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use InSync. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and truthful

3. Account Registration

To use InSync, you must:

  • Create an account with a valid email address
  • Connect your Spotify account via OAuth authorization
  • Choose a unique username and display name
  • Keep your account credentials secure and confidential

You are responsible for all activities that occur under your account. If you suspect unauthorized access, notify us immediately at support@insync-live.app.

4. Spotify Integration

InSync requires integration with Spotify. By using InSync, you agree to:

  • Comply with Spotify's Terms of Service and Privacy Policy
  • Maintain an active Spotify account (Free or Premium)
  • Grant InSync access to your Spotify listening data
  • Allow InSync to display your currently playing track to other users

You can disconnect your Spotify account at any time through the App's settings.

5. Acceptable Use

You agree to use InSync only for lawful purposes. You may NOT:

  • Harass, abuse, threaten, or intimidate other users
  • Post offensive, discriminatory, or hateful content
  • Impersonate others or create fake accounts
  • Spam or send unsolicited messages
  • Share sexually explicit, violent, or illegal content
  • Attempt to hack, reverse engineer, or compromise the App's security
  • Scrape or collect user data without permission
  • Use bots or automated systems to interact with the App
  • Violate intellectual property rights
  • Engage in fraudulent or deceptive practices

Violation of these terms may result in immediate account suspension or termination.

6. User Content

You retain ownership of content you create in InSync (messages, profile information, etc.). By posting content, you grant InSync a non-exclusive, worldwide, royalty-free license to:

  • Display your content to other users as part of the App's functionality
  • Store and process your content on our servers
  • Use aggregated, anonymized data for analytics and improvements

You are solely responsible for the content you post. We reserve the right to remove content that violates these Terms or is otherwise objectionable.

7. Privacy and Location Sharing

InSync displays your location on a live map when you are playing music. You have full control over location sharing:

  • Location sharing can be disabled in Privacy Settings
  • Your location is only visible when you have music playing and location is enabled
  • We do not store your historical location data

8. Intellectual Property

InSync and all related trademarks, logos, and intellectual property are owned by InSync or its licensors. You may not:

  • Copy, modify, or distribute our software or content
  • Remove copyright or trademark notices
  • Use our branding without written permission

Music content, album artwork, and artist information are owned by their respective copyright holders and provided through Spotify's API.

The InSync app, including its design, code, features, and documentation, is protected by copyright law. Unauthorized reproduction or distribution is prohibited.

If you believe content in the App infringes your copyright, please contact us with:

  • Description of the copyrighted work
  • Location of the infringing content
  • Your contact information
  • A statement of good faith belief

10. Third-Party Services

InSync integrates with third-party services (Spotify, etc.). We are not responsible for:

  • The availability, accuracy, or reliability of third-party services
  • Changes to third-party APIs or terms
  • Data practices of third parties (see their privacy policies)

11. Disclaimers

InSync is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Accuracy or completeness of content
  • Uninterrupted or error-free service
  • Security of data transmission

We do not guarantee that the App will always be available or function without errors.

12. Limitation of Liability

To the fullest extent permitted by law, InSync and its affiliates will not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or errors
  • Actions of other users
  • Unauthorized access to your account

Our total liability to you for all claims will not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless InSync from any claims, damages, or expenses arising from:

  • Your use of the App
  • Violation of these Terms
  • Violation of any rights of another party
  • Content you post on the App

14. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of other users
  • Extended inactivity

You may delete your account at any time through the App's settings or by contacting us. Upon termination:

  • Your access to the App will be revoked
  • Your account data will be deleted in accordance with our Privacy Policy
  • Some data may be retained in backups for up to 90 days

15. Dispute Resolution

If you have a dispute with InSync, please contact us first at support@insync-live.app to attempt an informal resolution.

Any legal disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. Governing Law

These Terms are governed by the laws of the United States and the state where InSync is headquartered, without regard to conflict of law principles.

17. Changes to the App

We reserve the right to:

  • Modify or discontinue features at any time
  • Change pricing for future premium features
  • Update the App with bug fixes and improvements
  • Conduct maintenance that may temporarily interrupt service

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

19. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and InSync regarding use of the App.
